ForeGate Creator Terms

The ForeGate team believes creators should have as much autonomy over their markets as possible. We aim to minimize moderation and instead focus on providing creators the tools they need to shape the content they want to see.

1. Parties and Scope of Terms

1.1 Contracting Parties

This terms is entered into by and between ForeGate Platform (hereinafter referred to as the “Platform”) and natural or legal persons (hereinafter referred to as “Creator”) who publish prediction markets, content, or creative tools through the platform.

1.2 Scope of Application

Applies to all content published by Creators on the platform, including but not limited to prediction contracts, market descriptions, rule explanations, tutorials, and community announcements.

1.3 Relationship between Platform and Creator

This terms does not create any employment, partnership, joint venture, or fiduciary relationship between the Platform and the Creator.

2. Identity and Eligibility Declarations

2.1 Creator Representations

  • Must be at least 18 years of age (or the age of majority in their jurisdiction) and have full legal capacity;

  • Must provide true, accurate, and complete identification information and keep it updated;

  • Must not be subject to any restrictions that legally prohibit the relevant activities (e.g., not listed on OFAC, UN sanctions, etc.).

2.2 Geographical Restrictions

  • Registration is prohibited for Creators located in sanctioned regions (e.g., Iran, North Korea, Crimea);

  • The Platform may suspend access if prediction markets are prohibited under Creator’s local law.

2.3 Forgery and Anonymity Prohibition

  • Creators shall not use forged, anonymous, or proxy identities to register or operate on behalf of others. Violations may result in immediate account suspension and legal action.

3. Account Rules

  • Accounts found impersonating others—whether individuals, groups, or organizations—may have their usernames changed. This includes any attempt to present yourself as someone you are not.

  • Usernames that violate our content guidelines will be temporarily replaced with a default name until the user updates it to something appropriate.

  • Profile pictures containing nudity or graphic violence will be replaced with a default image until the user updates it to something appropriate.

  • Accounts used for any of the following activities will be subject to penalties, even if they otherwise comply with the rules above:

  1. Repeatedly using multiple accounts to place bets on your own markets to gain the bonus by dishonest way.

  2. Using alternate accounts to impersonate others or mislead users through false identities.

  3. Created with the intent to influence or manipulate a market’s resolution.

4. Market Resolution

ForeGate ensures fairness and integrity in all prediction markets. This policy outlines how market outcomes are resolved and under what circumstances the platform may intervene.

4.1 Creator-Resolved Markets

  • If a Creator submits a market outcome, the platform reserves the right to verify the result, especially if:

  1. A user challenges the outcome;

  2. Conflicting data appears from trusted third-party sources;

  3. The Creator or related accounts have unusually large gains.

  • In case of a challenge, the Creator must provide clear and verifiable evidence (e.g. links, screenshots, on-chain proof). Payouts may be temporarily held during the review.

4.2 Markets Without Creator Resolution

  • If the Creator does not submit a result within 24 hours after market close:

  1. The platform may resolve the market based on reliable price data;

  2. If unclear, the market may be marked as Invalid, with user funds refunded;

  3. Remaining liquidity will be confiscated to cover system or audit costs.

4.3 Fraudulent Resolutions

  • The platform may re-open and re-resolve any market, even retroactively, if fraud is detected.

Fraud includes intentional misrepresentation of outcomes to benefit the Creator or associated users.

  • Actions may include:

  1. Marking the market as Invalid;

  2. Reversing payouts;

  3. Suspending the Creator’s privileges.

4.4 Official Tournaments and Platform Events

  • For ForeGate-sponsored markets (e.g. tournaments or featured events), the platform may step in to correct or finalize results if:

  1. The Creator fails to resolve on time;

  2. The outcome is disputed or unclear;

  3. Manipulation or conflict of interest is suspected.

4.5 Transparency and Appeals

  • All resolutions are logged and may be audited. Creators and users may submit appeals through the platform.

  • The platform will respond to appeals within 5 business days. During this time, payouts may be paused.

4.6 Market Settlement upon Exceptional De-Listing

If a market must be de-listed due to external reasons (e.g., public controversy, legal pressure, or platform-wide risk concerns), the following process applies:

  • Settlement Time: The market will be frozen immediately upon de-listing, and its final price will be determined by the YES/NO market price at the time of de-listing.

  • Payout Logic: User holdings will be settled at these final prices, and rewards distributed proportionally.

  • Fund Distribution: Remaining liquidity will be returned to the pool according to the final price ratios.

  • Creator Responsibility: Creators are required to cooperate in the resolution process. Refusal to comply may result in penalties or suspension.

  • Trading Freeze: No further trading or creator edits allowed after de-listing.

4.7 Zero-Volume Market Resolution

For markets that receive zero trading volume throughout their entire lifecycle:

  • Normal Process Continues: The Creator is still required to submit a result within 24 hours of market closing.

  • Settlement Sequence:

    • Result submission by Creator.

    • 2-hour window for user challenge (optional).

    • If there is no challenge, the system returns full pool (100%) to the Creator.

  • No Auto-Close: The market will not be automatically marked as Invalid solely due to inactivity.

  • Penalty for Omission: Failure to submit a result within the timeframe may result in forfeiture of the entire pool and Creator privileges.

This ensures accountability and consistent settlement across all markets, regardless of participation level.

5. Content Publishing Guidelines

5.1 Compliance and Authenticity

Published content and market rules must comply with applicable laws and regulations and must not contain misleading, illegal, infringing, or politically/sexually sensitive content.

5.2 Strictly Prohibited Market Types

  • Infringement on third-party privacy, reputation, trademarks, copyrights, or other legal rights;

  • Incitement, inducement, or manipulation of others into illegal or fraudulent transactions;

  • Fabricated or unverifiable outcome markets;

  • Content involving violence, hate speech, extremist politics, territorial disputes, or religious attacks;

  • Other content templates explicitly banned by the Platform.

  • Markets that feature images, videos, or links depicting sexually explicit content or significant violence, including death.

  • Markets that promote hate or discrimination based on race, gender, sex, or disability.

  • Markets that explicitly encourage or could potentially lead to terrorism or abusive behavior.

  • Markets with otherwise acceptable content that we may choose not to highlight on the homepage for reasons such as:

  1. Titles containing spoilers.

  2. Self-referential markets focused solely on their own engagement.

  3. Markets intended to exploit or manipulate the platform.

  • Markets that do not involve any genuine prediction.

  • Markets that are created with the intent to systematically exploit or redistribute platform-issued bonuses.

  • Markets designed to deceive or defraud participants.

  • This includes any market where the title or description explicitly states it will be resolved inaccurately.

  • Content that violates U.S. Law.

  • Markets focused on large-scale trading or commenting activity (e.g., “Will this market gain 100,000 comments?”) that could place excessive strain on the platform.

  • Markets or comments that expose personal or private information about individuals.

  • Content involving minors in a sexual context.

  • Any form of sexual exploitation, including blackmail, revenge porn, or similar behavior.

  • Markets or comments intended to harass, target, or intimidate specific individuals or groups, especially within the platform community.

  • Content depicting self-harm or suicide.

  • Markets that promote, encourage, or incentivize criminal activity.

  • Markets that encourage indiscriminate trading, commenting, liking, or posting behavior.

5.3 Risk Disclosure Obligation

For any prediction-related or financially risky content, Creators must clearly disclose disclaimers such as “Predictions are not investment advice” and “Participants assume all risks.”

5.4 Accuracy and Completeness

Creators must ensure clear participation rules, pricing mechanisms, settlement logic, and timing. Misleading or ambiguous content is prohibited.

5.5 Violation Handling

If Creators refuse to revise or remove non-compliant content, the Platform may immediately suspend accounts or delist markets without prior notice.

6. Market Conduct and Technical Standards

6.1 Smart Contract Parameters

All prediction market parameters (e.g., duration, odds, collateral) must be transparent pre-deployment. High-risk, unaudited parameters are forbidden.

6.2 Market Manipulation and Conflict Rules

  • No fake identities, Sybil attacks, or artificial activity;

  • Creators are prohibited from trading in their own markets;

  • If Creators are direct or indirect beneficiaries of market outcomes, such interest must be fully disclosed.

7. Review and Delisting Mechanism

7.1 Platform Review Rights

The Platform reserves the right to review Creator content, both pre- and post-publication. Content may be delisted or suspended if deemed misleading or non-compliant.

7.2 Violation Penalties

  • Content takedown, reward freeze, or contract revocation;

  • Account suspension or closure;

  • Legal action for serious breaches.

7.3 Emergency Delisting

Immediate removal without prior notice for:

  • Terrorist financing implications;

  • Child exploitation content;

  • Proven market manipulation.

7.4 Appeal Procedure

Within 48 hours of takedown, Creators may submit:

  • Legal opinion letters;

  • Third-party notarized data;

  • Refundable appeal bond (forfeit if appeal fails).

The Platform will conduct a preliminary review within 5 business days and issue a written decision. During the review, all suspensions remain in effect.

7.5 Appeal Bond Rules

  • Fully refunded if the appeal is upheld;

  • Applied to audit/arbitration costs if the appeal fails.

8. Revenue Sharing and Fee Policy

8.1 Revenue Composition

Creator earnings include post-fee share of market proceeds and community incentives.

8.2 Fee Responsibility

Creators bear gas fees, transaction fees, and maintenance costs per published market.

8.3 Platform Fee

Creators accept protocol-level fees (Protocol Fee) deducted automatically via smart contracts; no manual intervention is required.

9. Liquidity Provision and Loss Risk Disclosure

9.1 Asset Depreciation

Assets injected into liquidity pools may fluctuate due to market activity or settlement outcomes and could lose value.

9.2 Impermanent Loss

Markets using AMM models may lead to permanent losses from price rebalancing across options.

9.3 Slippage and Price Volatility

Large trades or volatility may lead to unfavorable price execution affecting pool value.

9.4 Smart Contract Risk

Creators bear losses from contract bugs, attacks, or oracle failures.

9.5 Withdrawal Restrictions

In extreme cases, the Platform may restrict asset withdrawals or pause liquidity.

9.6 Unstable Asset Risk

New or illiquid tokens, or de-pegged stablecoins, may increase pool exposure.

10. Losses Caused by User Trades

10.1 Direct Impact of User Activity

User positions directly affect pool composition and Creator P&L at settlement.

10.2 User Profits Are Paid from Creator Funds

If users heavily bet on YES (e.g., YES 99%) and are correct, the Creator must cover payout from their injected liquidity.

10.3 Arbitrage and Bot Risks

Even with careful pool setup, Creators cannot fully prevent bots or rapid trading strategies that extract value.

10.4 Creator Bears All Risks

The Platform guarantees fair user payouts. Creators bear all associated liquidity risks and will not be compensated by the Platform.

11. Final Adjudication Rights

11.1 Platform Discretion in Emergencies

Applies in cases such as:

  • Market manipulation or extreme arbitrage;

  • Smart contract incidents;

  • Disputed or unverifiable event outcomes;

  • Legal, regulatory, or compliance triggers.

11.2 Possible Platform Actions

  • Pause trades or freeze markets;

  • Restart or cancel liquidity pools;

  • Freeze Creator permissions;

  • Delay or override market outcomes.

11.3 Creator Assumes Losses

The Platform holds no liability for Creator losses caused by such interventions.

11.4 Disclosure Mechanisms

Notices will be issued via in-app messages, announcements, and social media. Creators must stay informed.

12. Intellectual Property and Licensing

12.1 License Scope

Creators retain copyright, but grant the Platform a non-exclusive, royalty-free, sublicensable, worldwide license for promotion, data analysis, and display.

12.2 Content Dispute Resolution

Creators are responsible for resolving third-party claims and indemnifying the Platform.

12.3 Derivative Rights

Creators authorize the Platform to:

  • Use prediction data for anonymized AI model training;

  • Generate NFTs or other derivative content.

12.4 Third-party Use

Creators grant the Platform and its affiliates the right to distribute or integrate content via API or third-party platforms.

12.5 Liability for Claims

Creators warrant that all content is original or properly licensed. They must fully indemnify the Platform in the event of legal claims, including attorney’s fees.

13. Confidentiality and Data Compliance

13.1 Confidentiality Obligations

Creators must not disclose non-public platform information (e.g., product roadmap, algorithms, user data) or use it for competitive purposes.

13.2 Data Compliance

Data use must follow the Platform’s whitepaper and privacy policy. No profiling or third-party ad targeting allowed.

13.3 Data Export

Exporting data requires prior written consent, with stated purpose and protections.

14. Termination and Exit Provisions

14.1 Voluntary Exit

Creators may exit by providing 30 days’ notice. The Platform will assist in clearing unresolved markets. 14.2 Unilateral Termination

The Platform may immediately suspend accounts in case of serious breaches or legal orders.

14.3 Post-Termination Obligations

  • Creators remain responsible for unsettled markets;

  • The Platform may withhold funds as a settlement reserve.

14.4 Inactivity Clause

If inactive for 180 days and unresponsive, the Platform may auto-terminate without notice.

15. Extended Liability

15.1 Creator Compensation

Creators must compensate the Platform for:

  • Undisclosed self-dealing;

  • IP violations;

  • Attracting users from sanctioned countries.

15.2 Right of Recourse

If the Platform must pay due to Creator’s misconduct (e.g., triggered smart contract settlements), it reserves the right to seek full reimbursement.

16. Governing Law and Dispute Resolution

16.1 Applicable Law

The terms are governed by the law of the Platform’s registered jurisdiction. Disputes shall be settled through good-faith negotiation first.

16.2 Liability Cap

Unless due to gross negligence or fraud, liability is capped at Creator’s past 90-day platform earnings.

16.3 Arbitration Clause

Disputes shall be submitted to international arbitration under UNCITRAL rules in the Platform’s jurisdiction, conducted in English. The ruling is final and binding. If mandatory arbitration is unenforceable, the dispute shall be settled by local courts.
